A good estate plan typically addresses several key objectives. It ensures that the individual’s property is conserved and managed effectively during their lifetime, including in cases of disability or incapacity. It also allows for the transfer of property to chosen beneficiaries, either during the individual’s lifetime or after their death, in a way that aligns with their preferences. Tools such as wills, trusts, life insurance policies, and durable powers of attorney are commonly used to achieve these goals
Additionally, estate planning considers the form in which assets are held and the legal consequences of different ownership structures. It is not solely about transferring property but also about ensuring that the individual’s needs and those of their beneficiaries are met, both during their lifetime and after their passing.
2. Trust administration in California refers to the process of managing and distributing the assets of a trust in accordance with the terms set forth by the trust's creator (the settlor) and applicable laws. The trustee, who is the individual or entity responsible for overseeing the trust, has a fiduciary duty to act in the best interests of the beneficiaries. This includes managing the trust's assets prudently, ensuring compliance with the trust's terms, and adhering to legal obligations such as recordkeeping and tax filings.
Key aspects of trust administration include maintaining detailed records of trust activities, preparing accountings, and providing beneficiaries with updates on the trust's status. Trustees must also handle any objections or disputes raised by beneficiaries, often with the assistance of legal counsel. Reasonable attorney fees incurred during trust administration can typically be paid from the trust's assets, provided they are necessary and appropriate for the trust's purposes
Additionally, trustees must ensure that the trust's assets are invested wisely, balancing growth with safety and income needs, and must distribute the trust's assets to beneficiaries as directed by the trust's terms. Trustees are held to a high standard of care and may be held liable for breaches of their fiduciary duties, such as mismanagement of trust assets or failure to act in the beneficiaries' best interests.
Proper trust administration ensures that the settlor's intentions are honored and the beneficiaries' rights are protected.
3. Probate - Probate administration in California is the court-supervised process of managing and distributing a deceased person's estate. This process ensures that the decedent's assets are collected, preserved, and distributed to the rightful beneficiaries, creditors, and taxing authorities. It also involves paying off any debts or claims against the estate, including administrative expenses, before distributing the remaining property to heirs or beneficiaries as specified in the decedent's will or, if no will exists, according to the laws of intestate succession.
The probate court has jurisdiction over the decedent's property, which includes determining the validity of a will, resolving disputes over the estate, and overseeing the actions of the personal representative (executor or administrator). The personal representative is responsible for tasks such as inventorying the estate, valuing assets, paying debts, and distributing the remaining property. This process is governed by the California Probate Code and may be supervised or unsupervised, depending on the circumstances.
